Pursuant to 235 ILCS 5/6-20 a person who is under 21 years of age who transfers, possesses or consumes alcohol faces a Class A misdemeanor. A Class A misdemeanor is punishable by up to 364 days in jail and a fine of $2,500 for each offense. Additionally, pursuant to Illinois Statute when a person is convicted of underage drinking the Illinois Secretary of State can suspend that person’s driver’s license even if the arrest or offense has nothing to do with a motor vehicle.
